Important Terms and Disclaimers
Please read the following terms, conditions and disclaimers carefully. By submitting an
enquiry or application through, or in connection with this platform, you acknowledge,
understand and agree to the following:
1. Governed by Compassionate Release Laws: By submitting this form or otherwise
engaging with the Advertiser’s service, you acknowledge that accessing your
superannuation for dental or medical treatment is governed by the Compassionate
Release of Superannuation provisions administered by the Australian Taxation Office
(ATO) under Australian law. Early release of superannuation for medical or dental
expenses is strictly controlled by these laws and is only permitted in exceptional
circumstances.
2. Strictly a Last Resort (Limited Eligibility): Access to superannuation funds for medical
or dental treatment is strictly limited to critical or medically necessary procedures in
very limited circumstances. It should be considered a last-resort option, used only
after you have fully explored and exhausted all other available options for paying for
the required treatment. In general, you must have no other financial means to pay for
the treatment in order to qualify for a compassionate release of superannuation.
3. No Guarantee of Approval: Submitting an enquiry or application through this service
does not guarantee that you will be permitted to access your superannuation.
Approval for early release of superannuation is not automatic or assured. Any
release of funds depends entirely on the eligibility criteria set by the ATO, the
supporting evidence and certifications provided by registered health practitioners that
ultimately you choose to use, and your individual personal circumstances. The ATO
and your superannuation fund have sole discretion in determining whether you meet
the required conditions. The Advertiser, as the platform operator, has no influence on
and no involvement in the ATO’s or your fund’s decision-making process.
4. Compliance with Health Advertising Standards: The Advertiser, where legally
required, is committed to complying with all relevant professional obligations and
legal requirements relevant to the advertising of health services. This includes
adherence to the guidelines of the Australian Health Practitioner Regulation Agency
(AHPRA) and the standards set by the relevant National Boards for health
practitioners, to the extent applicable. All information and advertising material
provided by the Advertiser is intended to be clear, honest, factual, and not
misleading. The Advertiser will not directly or indirectly encourage the indiscriminate
or unnecessary use of any regulated health service, nor make any unlawful or
misleading claims in its advertising or communications.
5. General Information Only (No Inducement): Any information provided by the
Advertiser, whether through its website, via email or phone, in written materials, or by
any other communication, is supplied strictly on a general, factual, and educational
basis. Nothing the Advertiser provides is intended to encourage or induce you to
access your superannuation, to apply for an early release of superannuation, or to
undergo any dental or medical treatment. The purpose of this information is to help
you understand the process and requirements if you choose to consider using your
superannuation for eligible treatment costs; it is not provided to persuade you to take
any particular course of action.
6. Only Critical Conditions Eligible: The option to access superannuation for medical or
dental treatment is available only for certain qualifying conditions and treatments as
defined under the law. Examples of eligible circumstances may include treatment
required to alleviate acute or chronic pain, treatment of a life-threatening illness or
injury, or treatment of another severe condition that is recognised by the ATO as a
valid ground for compassionate release of superannuation. Routine or elective
procedures that fall outside those criteria will not qualify for an early superannuation
release.
7. Medical/Dental Practitioner Certification Required: Any application to the ATO for the
early release of superannuation on compassionate grounds must be supported by a
certification or report from a registered medical practitioner or registered dental
practitioner (as appropriate) with the relevant expertise. The practitioner must certify
that the proposed treatment is necessary for the reasons allowed under the
compassionate release provisions (for example, to alleviate acute or chronic pain, or
to treat a life‑threatening or seriously debilitating condition). Only a qualified and
registered health practitioner can make this determination and provide the required
supporting documentation. Neither the Advertiser nor any other non-practitioner
entity is authorised to certify or declare that you meet the medical criteria for early
superannuation access.
8. Independent Clinical Judgment (No Influence): Any certification, recommendation, or
report provided by a medical or dental practitioner (of your choosing) in support of
your application will be based solely on that practitioner’s independent clinical
judgment and professional assessment of your condition. The Advertiser has no
involvement in and no influence over any healthcare practitioner’s judgment or the
content of any medical certificate or report. The responsibility for diagnosing your
condition, determining the necessity of treatment, and certifying eligibility for
compassionate release lies entirely with the treating practitioners (of your choosing)
and not with the Advertiser.
9. Not a Health/Financial Provider (Facilitator Only): You acknowledge that the
Advertiser is not a healthcare provider and is not providing any medical or dental
advice, diagnosis, or treatment to you. The Advertiser is also not a financial adviser,
tax professional, or legal adviser. The Advertiser’s service operates solely as a
facilitation and marketing platform (i.e. an advertising and referral service) to provide
general information about the compassionate release of superannuation process and
to connect individuals with dental or medical providers. The Advertiser is not
registered with AHPRA or any state health regulator, as it does not provide regulated
health services. For clarity, the Advertiser’s role is strictly limited to being a conduit
that connects you with health service providers and provides general information. It
does not provide, approve, or recommend any medical treatment or any financial
product or pathway. All decisions regarding your medical care must be made in
consultation with qualified health practitioners, and any financial or legal decisions
should be made after consulting qualified professionals in those fields.
10. Seek Independent Financial (and Legal) Advice: The Advertiser strongly
recommends that you obtain independent financial advice and, if appropriate,
independent legal and tax advice, before making any decision to apply for the early
release of your superannuation or to incur costs for any dental or medical treatment.
Accessing your superannuation early can have significant financial and tax
implications. A licensed financial adviser can help you understand the potential
impact on your personal financial situation, retirement savings, insurance
arrangements, and tax obligations. Any decision you make to proceed with an
application for early release of superannuation should be made with full
understanding of the consequences and ideally with guidance from qualified
professionals familiar with your personal circumstances.
11. No AFSL – No Financial Advice: The Advertiser does not hold an Australian Financial
Services Licence (AFSL) and does not provide any form of financial product advice
or any other financial services that would require such a licence. The Advertiser will
not influence or advise you to dispose of or access a financial product (including your
superannuation) in any way that would violate financial services laws. You
acknowledge that any information or discussion concerning accessing
superannuation is provided strictly to explain the general process and eligibility
criteria. It is not a recommendation or personal advice that you should pursue this
option. Influencing or advising an individual to access their superannuation without
holding an appropriate licence may breach the Corporations Act 2001 (Cth). The
Advertiser does not engage in any activity that contravenes those provisions, and
nothing in its communications is intended to constitute unlicensed financial advice or
to induce you to act on a financial product.
12. Your Decision – Your Responsibility: By proceeding with an enquiry or application
through the Advertiser’s service, you acknowledge and agree that the Advertiser has
not provided you with personal financial advice, investment advice, or any
recommendation to apply for early release of superannuation. You are solely
responsible for any decision you make to apply for the compassionate release of
your superannuation funds. Any decision to apply for early release is made of your
own volition, based on your own assessment of your needs and circumstances
(ideally in consultation with your independent financial and legal advisers and
healthcare providers), and not based on any advice or encouragement from the
Advertiser.
13. Facilitation Only – No Control Over Outcome: When the Advertiser assists you with
the administrative aspects of a potential application (for example, by providing
information or forwarding your details to a practitioner for evaluation), it does so to
help facilitate the process, but it cannot and does not guarantee any particular
outcome. The ATO (and, where applicable, the trustee of your superannuation fund)
will independently assess any application for early release of superannuation. They
have full authority to approve or refuse your application at their discretion, in
accordance with the law and the evidence provided. For instance, the ATO may
reject an application if the proposed treatment or the supporting documents (such as
medical certificates and expense quotes) do not strictly satisfy the statutory criteria,
or if any required information is missing or insufficient. You accept that any
application you submit may be refused by the ATO or your fund, and that the
Advertiser has no control over, or ability to influence, their decisions.
14. Independent Platform – Not an Agent: The Advertiser is an independent entity and is
not an agent, representative, or partner of the ATO, any superannuation fund, any
government department, or any medical or dental practice (unless explicitly stated
otherwise in a specific context). The Advertiser does not act on behalf of the ATO or
any superannuation fund in any capacity. While the Advertiser may facilitate your
communications with a dental or medical practitioner or assist in the process of
preparing an application, it does not act as an agent for you or for any practitioner in
a legal sense. It also does not guarantee the services or outcomes provided by any
practitioner. There is no official endorsement of the Advertiser’s service by any
government or regulatory authority. Any assistance or information provided by the
Advertiser is given as an independent third-party facilitator, and you should not
interpret any communications as being provided by or on behalf of the ATO or any
other governmental body.
15. General Information – Not Personal Advice: All information, content, and
communications you receive from the Advertiser, whether via its online forms,
website, email, telephone, messenger service, or any other channel, are general in
nature. Such information is provided to help you broadly understand the
compassionate release of superannuation process and related requirements.
However, it is not tailored to your personal circumstances, and you should not regard
it as personal advice (financial, tax, legal, medical or otherwise) specific to your
situation. The Advertiser endeavours to ensure that the information provided is
accurate and up-to-date, but it remains your responsibility to verify how the
information applies to you and to seek advice from qualified professionals for
guidance tailored to your individual circumstances. You should not delay seeking
professional advice, nor disregard advice you have received from your own advisers,
based on something you have read or heard in the Advertiser’s materials or
communications.
16. Acceptance of Terms: By clicking “Submit” on any form on the Advertiser’s website or
platform, or by otherwise actively indicating your agreement (for example, by ticking
an acceptance box or proceeding past a disclaimer notice), you confirm that you
have read and understood all of the terms, conditions, and disclaimers set out herein
(and in any linked terms page or document), and that you accept these terms and
agree to be bound by them. In particular, you acknowledge that any information
provided to you through the Advertiser’s service is furnished for general information
purposes only, to assist you in understanding the process for compassionate release
of superannuation and the associated clinical certification requirements. You accept
that this information does not constitute, and is not a substitute for, personal financial
advice, legal advice, or medical advice. Your act of submitting the form (or an
equivalent action indicating consent) signifies your acceptance of these terms and
your agreement that you are proceeding on your own initiative after having
understood the above terms/disclaimers.
17. Long-Term Financial Impacts: You acknowledge that accessing your superannuation
early may have significant long-term financial consequences. Withdrawing
superannuation funds now will generally reduce the balance of your retirement
savings, meaning you will have less money in your superannuation for your
retirement years. This could adversely affect your future financial security and
lifestyle in retirement. Early withdrawal of superannuation might also have
implications for any insurance policies you hold through your superannuation fund
(such as life, TPD or income protection insurance) and could potentially affect your
eligibility for certain government benefits or entitlements (for example, Centrelink
benefits or other means-tested welfare) both now and in the future. It is your
responsibility to carefully consider these potential impacts. The Advertiser strongly
urges you to weigh these factors and to discuss them with your financial adviser
before deciding to proceed with an early release of superannuation.
18. Genuine Enquiries Only: You must only submit truthful, accurate, and genuine
enquiries, applications and information through the Advertiser’s service. This service
is intended to assist individuals who have a bona fide interest in obtaining dental or
medical treatment and who wish to understand the process for compassionate
release of superannuation in that context. If the Advertiser suspects that any enquiry
or submission is not genuine, that is for example, if it is made under false pretences,
is intended to harass or disrupt, or is an attempt to improperly gather information
about its operations, the Advertiser reserves the right to refuse to respond or to
continue interacting with that enquiry. The Advertiser also reserves the right to take
appropriate action in response, which may include (but is not limited to) cancelling
the enquiry, terminating any further communication, and, where warranted, reporting
the matter to relevant authorities. Making false or fraudulent enquiries or applications
may be unlawful. The Advertiser will take necessary steps to protect its rights and
interests (and those of its legitimate clients) if misuse of the service is detected.
19. Terms Subject to Change: These terms and disclaimers are subject to change. The
Advertiser may update or revise this content from time to time to reflect changes in
the law, in regulatory guidance, or in its business practices. The version of the terms
and disclaimers in effect at the time you submit an enquiry or form will generally be
the version that governs that submission. If any provision of these terms is found to
be invalid or unenforceable by a court or regulator, that provision will be deemed
severed from this document to the minimum extent necessary, and the remainder of
the terms will continue in full force and effect. By continuing to use the Advertiser’s
service, you agree to regularly review the terms and to be bound by the most current
version.
